5. Intellectual Property

5.1 Our Content

All content, features, and functionality of our services (excluding user-generated content) are owned by ForceBoostAI and protected by intellectual property laws.

5.2 Your Content

You retain ownership of content you input into our services. By using our services, you grant us a limited license to process your content solely for providing the service.

5.3 AI Outputs

Subject to these Terms and your subscription plan, you own the outputs generated by our AI in response to your prompts. You are responsible for ensuring your use of outputs complies with applicable laws.

6. Payment Terms

6.1 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law.

6.2 Price Changes

We may change our prices with 30 days' notice. Continued use after price changes constitutes acceptance of the new pricing.

6.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

7. API Usage

If you access our services via API, you additionally agree to:

  • Keep your API keys confidential
  • Not exceed your plan's rate limits
  • Not resell API access without authorization
  • Implement appropriate error handling
  • Display required attribution where applicable

8. Disclaimers

Service Provided "As Is"

Our services are provided "as is" without warranties of any kind. We do not guarantee that:

  • The service will be uninterrupted or error-free
  • AI outputs will be accurate or suitable for any purpose
  • Defects will be corrected

AI-generated content should be reviewed before use. We are not responsible for decisions made based on AI outputs.

9. Limitation of Liability

To the maximum extent permitted by law, ForceBoostAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

  • Loss of profits, data, or business opportunities
  • Service interruptions or data loss
  • Any damages arising from AI outputs

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ForceBoostAI, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate using our services

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Suspicious or fraudulent activity
  • Extended periods of inactivity
  • Legal or regulatory requirements

Upon termination, your right to use our services ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or our services shall first be attempted to be resolved through informal negotiation. If unsuccessful, disputes shall be resolved through binding arbitration.

Continued use after changes constitutes acceptance of the modified Terms.
